Agreements, Terms & Conditions

Affiliate Agreement: Let’s Break It Down (Effective from 30.09.2024)
Alright, buckle up! This Affiliate Agreement is like the user manual for your partnership with Icareforex Ltd. The investment firm Icareforex Jordan Ltd., with company number 57026, registered address at Icare Forex Limited, Reg. No. 15807, Hamchako, Mutsamudu, Autonomous Island of Anjouan, Union of Comoros. Here’s the gist: once you’re approved to promote their services, this agreement kicks in. From then on, you're in business together. Let’s dive into the nitty-gritty, but don’t worry—we’ll keep it light.

1. DEFINITIONS:
Discretionary Services: The broker makes the trades without calling you every five minutes. Handy, right?
Margin Trading: It’s like borrowing money to bet bigger, but don’t forget—big risks mean you could lose more than your deposit.
Partner Code & Referral Link: Your personal magic keys to track all those clients you bring in.

2. CONTENT AND SCOPE:
You’ll be hyping ICFXL Markets—just make sure to keep things legit. Only promote their services, bring in clients through your referral link, and follow the rules. And remember, no funny business—if you break the rules, it’s game over.

3. MARKING ACTIVITY:
Want to create marketing materials? Awesome, but you’ll need the green light from ICFXL first. Keep it ethical—no spammy tactics, cold calls, or scumware (yep, that’s a thing). If you need to send out emails, ask for permission.

4. FEE:
Here’s the fun part—your fee. This is how you get paid for your marketing magic. But beware, no shady tricks to bump up your earnings, like fake trades or scamming the system. Your earnings are calculated and shown in your Partner Room, but ICFXL has the final say on any number crunching.

5. PARTNER OBLIGATIONS:
Advertise fairly and ethically—no sugarcoating or misleading claims.
Keep checking the rules and terms on ICFXL’s site—they might change, and you don’t want to miss it.
No targeting minors or making deals with shady customers—keep it clean.
Follow all the laws, and if a conflict of interest pops up, disclose it.

6. CONFIDENTIALITY:

Got sensitive info from ICFXL? Keep it under lock and key. If you’re unsure whether something’s confidential, assume it is and ask before sharing.

7. INTELLECTUAL PROPERTY RIGHTS:
Everything ICFXL gives you to promote their brand—logos, materials, and tools—still belongs to them. Don’t mess with their intellectual property, and definitely don’t infringe on anyone else’s.

8. RECORDKEEPING & AUDITING:
Hold on to your records for at least 10 years—you heard that right, 10 years. ICFXL can ask for them anytime, and you’ve got 48 hours to provide what they need.

9. LIABILITY:
If you mess up and it costs ICFXL, you’re on the hook. Play it safe and stick to the agreement.

10. TERMINATION:
Want out? You or ICFXL can end this partnership with three days' notice. But if you break the rules, they can cut ties instantly. And if you haven’t brought in a new client in six months, don’t be surprised if they show you the door.

11. FORCE MAJEURE:
Think of this as the "life happens" clause. If something like a natural disaster or market meltdown happens, ICFXL can take action without notice, and they won’t be held responsible for any hiccups it causes.

12. FINAL PROVISIONS:

ICFXL can tweak this agreement as needed, and they’ll let you know. If you don’t agree, you can walk away, but if you stay silent, it’s considered a thumbs-up.
Any disputes? Try to resolve them amicably first, but if things go south, it’ll be settled in the courts of the Hashemite Kingdom of Jordan.
Oh, and your e-signature is just as good as a real one.

IN WITNESS WHEREOF, the parties have sealed the deal. Now, go forth and market like a pro!

Marketing Rules—The No-Nonsense, Keep-It-Legal Guide

If you’re promoting ICFXL, here’s your playbook to stay compliant and sharp with your marketing efforts.

1. Basic Rules for Financial Promotions:

1.1 Name it: Make sure the name "ICFXL" is front and centre.
1.2 Truth, the whole truth: Be accurate and don’t hide risks—be as clear about them as you are about the shiny benefits.
1.3 Font matters: No funny business with tiny fonts—risk warnings should be as bold and big as the rest of the text.
1.4 Speak their language. Make it easy for your audience to understand—no jargon, no trickery.
1.5 Don't bury the lead: Don’t hide important information in a sea of fluff—give it the spotlight it deserves.
1.6 Pick a language: Stick to one language unless the client is cool with more.
1.7 Keep it fresh: Make sure the information is current and fits the format you’re using (whether it’s a tweet or a webinar).
1.8 Good and bad: Show both sides of the coin—highlight potential gains and losses.
1.9 Risk warning: Every promo needs to scream about the risks—don’t skip this!

2. SEO Articles and Analysis Posts:

2.1 Fair comparisons: If you're comparing products, do it fairly—don’t tilt the scales.
2.2 Source it: Always back up your facts and assumptions with sources.
2.3 No rose-coloured glasses: If you're referencing past performance, slap on a disclaimer—past glory doesn’t guarantee future success!
2.4 No crystal balls allowed. If you're talking future performance, keep it real—use objective data and be transparent about fees and charges.

3. Social Media Tips:

Twitter: Keep it sharp with a risk warning. Use a main title and subtitle if needed—no 20% text rule here.
Facebook: Limit text on images, and don’t crowd the bottom left (that’s where your avatar lives). Always include a risk warning!
LinkedIn & Instagram:
Keep risk warnings on hand, and don't go overboard with text.

4. Banners—Keep It Clean:

4.1 Clear as day: Use short, simple language. Nobody’s impressed by your jargon.
4.2 Tailored: Know your audience and speak directly to them.
4.3 Key info first: Make sure the important stuff is front and centre.
4.4 Balance the act: Don't oversell the product without highlighting the risks.

Common Mistakes to Avoid on Banners:

Forgetting the risk warnings.
Only talking about the perks—don’t forget to mention the risks too.
Overselling with unrealistic promises—keep it grounded.

5. Video Marketing Musts:

5.1 Risk warning visible: Make sure it doesn’t sneak off the screen!
5.2 For TV commercials: The risk warning must be “sticky” and visible the entire time.
5.3 Final frame: Use the last seconds for company details and a longer risk warning.

6. Risk Warnings—They’re a Must Have:

6.1 Loud and clear: Risk warnings must be prominent, not something you sneak in.
6.2 Static: On websites, keep it fixed at the top, even as users scroll.
6.3 Proportional: Make sure the size of your risk warning fits the overall design—it shouldn’t look like an afterthought.

7. References and Disclaimers:
Always cite your sources for charts, analysis, and images—no stealing! Past performance doesn’t predict future results, and any analysis should come with a disclaimer about risks.

Example:
Charts: Include where you got them from and a disclaimer that past performance doesn’t guarantee future results.

Reminder: Be fair, transparent, and show both the risks and rewards. Keep it legal, and your marketing will be effective!

Marketing and Financial Promotion Guidelines

Buckle up, Affiliates and IBs! If you’re rolling out promotions for ICFXL, you’ve got some rules to follow. Consider this your fun but essential guide to keeping your marketing sharp and compliant—because no one wants to end up in the penalty box!

1. General Conditions

1.1 Part of the Deal: These guidelines are locked into your affiliate agreement—updates happen, so keep your eyes peeled.
1.2 Stick to the Script: Only use ICFXL-approved promo tools from your Partners’ Room.
1.3 Get Approval: Don't go rogue! No sneaky social ads or email blitzes without a thumbs-up from ICFXL first.
1.4 Know the Rules: Double-check the local laws for your promo turf.
1.5 Marketing Communication: Covers everything from emails to social media to skywriting (okay, maybe not skywriting) aimed at introducing clients to ICFXL.
1.6 No Investment Advice: Stick to marketing—no playing financial advisor, portfolio manager, or armchair quarterback.
1.7 18+ Only: ICFXL’s products are for adults only. Sorry, kiddos.
1.8 Country Restrictions: Want the full list of places where ICFXL doesn’t operate? Ask your manager.

2. Monitoring

2.1 Big Brother is Watching:
ICFXL monitors your promotions to make sure you're playing by the rules. If things get messy, they might bench you.
2.2 Quick Fix: If they ask you to change something, you’ve got 24 hours to make it right.
2.3 Stuck? Let your manager know if you need more time.
2.4 Stay Updated: Keep ICFXL in the loop about any promo changes you make.
2.5 Rule Changes: If the regulators tweak the rules, so do we. Stay on top of updates.

3. Use of Risk Warnings

3.1 Full Disclosure: Always highlight the risks in your marketing—no surprises.
3.2 Bold & Clear: Make sure warnings are easy to read, in your face, and not lost in the fine print.
3.3 What Needs a Risk Warning?

Any call to action (e.g., “Sign up now!”).

Anything linking to ICFXL content.

Disclaimer: "Retail investor accounts lose money when trading CFDs with this provider. You should consider whether you can afford to take the high risk of losing your money."

3.3.4 Personal Examples:
If you're using your own trading experience, don’t forget:
"Past performance is not a reliable indicator of future results."

5. Talking Performance

3.3.5 Past Performance:

Don’t make it the star of the show.
Cover the last five years or the life of the product.
Include: "Past performance is not a reliable indicator of future results."

3.3.6 Future Performance:

No fortune-telling! Forecasts must be based on solid data.
Include fees and commissions.
Add a warning: "Such forecasts are not a reliable indicator of future performance."

6. Language

Keep it Simple: Speak clearly and avoid jargon. If you must use it, explain it.
Know Your Audience: Tailor your message to your crowd's financial knowledge level.

7. No Investment Advice

5.1 No Advice Zone:
You’re not licensed to give financial advice, so steer clear of playing money manager.

8. Transparency

6.1 Be Real: Use your real name and contact info—no fake identities, please!
6.2 One Contact Per Customer: Stick to one email or phone number.
6.3 Consent is Key: Don’t hit up clients without their permission.
6.4 Don’t Play Pretend: Never act like you’re an employee or agent of ICFXL.

That’s the playbook! Keep these guidelines handy, stay legal, and remember: honesty, clarity, and a splash of humour will take you far in the world of marketing.
